Terms of Service

Plain English, on purpose. These terms are the agreement between you and Job Scaler LLC when you use our website or buy our services. If something here doesn't make sense, ask us before you sign up — we'd rather explain it than argue about it later.

1. Who we are

Job Scaler LLC is a Massachusetts limited liability company operating as JobScaler. Throughout this document, "we," "us," and "our" mean Job Scaler LLC. "You" means the person or business using our site or services. Reach us any time at chris@jobscaler.io.

2. What we provide

We build and run marketing and front-office automation for contractors and trades. There is one plan, and it includes a custom website with hosting and maintenance, missed-call text-back, a website lead chat that captures visitor inquiries, automatic review requests, local search setup, and follow-up campaigns to past and repeat customers.

We'll tell you what's included before you pay. We may improve or change how a feature works over time, but we won't quietly remove something you're paying for — if we retire a feature, we'll tell you first and you can cancel.

3. What we need from you

To do our job we need accurate information from you, timely access to accounts we need (phone number, website, Google Business Profile, and so on), and reasonable responsiveness when we ask a question. If we can't get what we need, we may not be able to deliver on time, and we're not responsible for delays that come from that.

You're responsible for what you publish through our tools and for following the laws that apply to your business.

4. Pricing, billing, and cancellation

The plan is $297 per month billed monthly, or $3,000 per year, billed as one annual payment (equivalent to $250/month), at the prices shown on our pricing page when you sign up. There's no setup fee — the website build is included in the monthly price. Prices are in U.S. dollars and don't include any taxes that may apply.

There's no cancellation fee. Monthly billing is month-to-month: cancel any time and your service ends at the close of your current billing period, and we don't prorate partial months. Annual billing is a 12-month prepaid term: if you cancel, you keep access through the end of the term you paid for.

30-Day Money-Back Guarantee. New JobScaler customers may request a full refund of amounts paid within 30 days of their initial purchase. This guarantee applies to both monthly and annual billing options. After the first 30 days, monthly payments are non-refundable once charged, and annual payments are non-refundable for the remainder of the prepaid annual term except where required by law.

If we change prices, existing customers get at least 30 days' notice before it affects them.

5. What happens when you leave

Be clear-eyed about this one. The plan is a service, not a purchase. When you cancel, the automations stop running and — if we host your website — that site comes down. Nobody is holding your business hostage, but you're not buying a system you take with you.

Your own data stays yours. Ask within 30 days of cancelling and we'll export your contacts, call logs, and review history in a standard format at no charge. Your phone number, domain, and Google Business Profile were always yours — we hand back any access we were given.

6. Text messaging

Some features send text messages to your customers on your behalf. That carries real obligations, and they mostly land on you as the business sending them.

You confirm that you have permission to text the people in your contact list, that the messages relate to the business relationship you have with them, and that you'll follow the Telephone Consumer Protection Act and any other law that applies. We honor STOP, UNSUBSCRIBE, and HELP automatically on every number we manage, and we won't disable that.

Message and data rates may apply to recipients. Message frequency varies with your call and job volume. Carriers can filter, delay, or block messages for reasons outside our control, and we can't guarantee delivery. If a carrier or messaging provider suspends your number for a compliance problem, we'll help you sort it out, but we can't promise it will be restored.

7. Who owns what

You own your business content — your logo, photos, copy, customer list, and anything you give us. You're granting us permission to use it to run your service, and that's all.

We own our own tooling, templates, automation logic, and the systems behind the service, including anything we build to make it work. We may show your project as an example of our work unless you tell us not to — just ask and we'll leave you out.

8. Third-party services

Our service depends on other companies — phone carriers and messaging providers, Google, Meta, scheduling and hosting platforms. Their outages, policy changes, and account decisions are outside our control. We'll work around problems where we can, but we're not liable for what those providers do.

9. What we don't promise

We work hard to keep everything running, but we provide the service "as is." We don't guarantee a specific number of leads, jobs, reviews, or any particular revenue result. What we catch depends on the calls you're already getting. We don't guarantee uninterrupted or error-free operation, and to the fullest extent the law allows, we disclaim implied warranties of merchantability and fitness for a particular purpose.

10. Limits on liability

To the fullest extent allowed by law, our total liability for any claim related to the service is capped at the amount you paid us in the twelve months before the claim arose. We're not liable for lost profits, lost business, or other indirect or consequential damages. Some states don't allow these limits, so parts of this may not apply to you.

11. Indemnification

If someone brings a claim against us because of your content, your customer list, messages sent on your behalf without proper consent, or your violation of these terms, you agree to cover our reasonable costs of defending it.

12. Suspension and termination

We may suspend or end service if payment fails, if the service is being used in a way that breaks the law or carrier rules, or if continuing would put our other customers at risk. Except in urgent cases, we'll tell you what's wrong and give you a fair chance to fix it first.

13. Changes to these terms

We may update these terms as the business changes. If a change materially affects you, we'll give at least 30 days' notice by email or on this page before it takes effect. Continuing to use the service after that means you accept the new version.

14. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Massachusetts, and we both agree to that jurisdiction.
